Terms and Conditions applicable to NHS and Care Volunteer Responders and Terms and Conditions applicable to use of the GoodSAM Services

Royal Voluntary Service has been appointed by NHS England to recruit and deploy a network of volunteers throughout England who are willing and able to provide support to communities and the wider Health & Care systems programme.

GoodSAM has been appointed by NHS England to make available to Royal Voluntary Service and its volunteers, certain software, digital products and/or services to support the running of the volunteer programme.

This document sets out:

  • The terms and conditions which will apply to an individual who applies to become or is accepted by Royal Voluntary Service as a Volunteer Responder (as defined below). Such terms and conditions include terms which govern the relationship between Volunteer Responders and Royal Voluntary Service and lay down standards and rules which Volunteer Responders are expected to comply with ('Volunteer Terms and Conditions'); and
  • The terms and conditions which will apply to an individual who uses any of the GoodSAM Services (as defined below). Such terms and conditions include terms which govern the relationship between GoodSAM and individuals who use the GoodSAM Services the basis on which individuals are permitted to use the GoodSAM Services ('GoodSAM Terms and Conditions').

By making an application to become an Volunteer Responder, an individual will be deemed to have accepted the Volunteer Terms and Conditions, the GoodSAM Terms and Conditions and all other terms set out in this document. Please do not proceed with your application if you do not agree to such terms.

Definitions

In this document, for ease of reference, a variety of defined terms are used:

"GoodSAM" means GOODSAM LIMITED (a company incorporated in England and Wales with registered number 8742979) whose registered office is at 1 Curtain Road, London EC2A 3JX;

"GoodSAM Services" means the services made available through the GoodSAM Website and/or the GoodSAM Volunteer Responder App or any other GoodSAM app;

"GoodSAM Website" the following website owned and operated by GoodSAM goodsamapp.org/NHS;

"NHSE" means National Health Service England;

"Volunteer Responder" means an individual who volunteers with Royal Voluntary Service in connection with the Volunteer Responder Programme;

"Volunteer Responder App" means a mobile application owned and run by GoodSAM and adapted by GoodSAM for use by Volunteer Responders in connection with the Volunteer Responder Programme;

"Volunteer Responder Programme" a programme introduced by NHSE and established and run on behalf of NHSE by Royal Voluntary Service to to recruit and deploy a network of volunteers throughout England who are willing and able to provide support to communities and the wider Health & Care systems.;

"Royal Voluntary Service" means Royal Voluntary Service (a charity registered in England and Wales with charity number 1015988 and a registered company limited by guarantee with number 2520413) whose registered office is at Hanley Centre, 29 Charles Street, Stoke-on-Trent, Staffordshire ST1 3JP;

"You" and/or "Your" an individual to whom the Volunteer Terms and Conditions and/or the GoodSAM Terms and Conditions are directed.

Volunteer Terms and Conditions

For the avoidance of doubt, the Volunteer Terms and Conditions apply as between you and Royal Voluntary Service both if you: (i) apply to become an Volunteer Responder; and (ii) if you are accepted by Royal Voluntary Service as an Volunteer Responder.

1. Your relationship with Royal Voluntary Service

Royal Voluntary Service is responsible for overseeing, running and managing the Volunteer Responder Programme. As such, if you apply to become an Volunteer Responder, you are applying to become a Royal Voluntary Service volunteer and if you are accepted as an Volunteer Responder, you will become a Royal Voluntary Service volunteer. However, you will only be volunteering to provide support and assistance in connection with the Volunteer Responder Programme.

2. Rules which apply to you as a Volunteer Responder

In addition to the terms set out in these Volunteer Terms and Conditions, various other rules, standards and requirements will apply to you as an Volunteer Responder. These are set out in the 'Getting You Started Guides' applicable to the different Volunteer Responder activities. The Getting You Started Guides can be found in the 'I'm a Volunteer' section of our Volunteer Responder website (see nhsandcarevolunteerresponders.org/volunteer).

Royal Voluntary Service may amend the Volunteer Terms and Conditions and its Getting You Started Guides from time to time and they will apply to you as amended.

By applying to become a Volunteer Responder you are agreeing that you understand what the activities of a Volunteer Responder entails and have seen, read and understood these Volunteer Terms and Conditions and the applicable Getting You Started Guides and will at all times observe the provisions set out in them.

In particular, you agree that all support and assistance provided by you as a Volunteer Responder will be provided free of charge, save in relation to expenses. Details of the expenses you are entitled to claim as a Volunteer Responder and how you can do so are set out in the Volunteer Responder Programme expenses policy (which will be sent to Volunteer Responders once they have completed a volunteering task).

3. Performance as a Volunteer Responder

In performing your activities as a Volunteer Responder you must:

  1. Comply with the requirements and obligations set out in the applicable Getting You Started Guides and volunteer resources on the Volunteer Responders website and any updates we send out;
  2. Maintain the confidentiality of all information which may come into your possession relating to the members of the public you are asked to support;
  3. Ensure that you promptly and securely dispose of any notes or reminders you create relating to a volunteering task once that volunteering task has been performed;
  4. At all times act with all due care and diligence; and
  5. Comply with any additional instructions provided to you from time to time by Royal Voluntary Service.

Volunteer Responders are required to download and install the GoodSAM App so that they can receive notification of volunteer tasks in their area. The GoodSAM App is owned and operated by GoodSAM and use of the GoodSAM App will be subject to the GoodSAM Terms and Conditions (see below).

Volunteer Responders are under no obligation to accept any volunteer tasks notified to them.

4. Protecting yourself

Royal Voluntary Service wishes to ensure the safety of its Volunteer Responders at all times. As such, when acting as a Volunteer Responder, you are required to follow the safety measures and instructions set out in the Getting You Started Guides and Volunteer Resources applicable to the activities you will be undertaking.

5. Applications

If you wish to apply to become a Volunteer Responder, you need to fill out an online application form (which is hosted on Royal Voluntary Service's behalf on the GoodSAM Website). Your use of the GoodSAM Website will be subject to the GoodSAM Terms and Conditions (see below).

Once you have made an application, it will be submitted to Royal Voluntary Service who will check the application to ensure that:

  1. You have provided all information required;
  2. You are over 18 years of age and residing in England;
  3. You have provided the necessary documentation to verify your identity;
  4. If a DBS check is required, you have provided the relevant documentation and have the requisite level of DBS clearance for the activity you have applied for.

Royal Voluntary Service will reject applications which do not satisfy the criteria listed above. However, in relation to activities where a DBS check is required, if you do not have the requisite level of clearance for all activities applied for, you may be accepted for limited activities.

Royal Voluntary Service will have general discretion to reject an application if, acting reasonably, it believes that an individual is not suitable to take on the role of a Volunteer Responder.

6. Suspending or terminating appointments

Royal Voluntary Service will have the right to suspend or terminate your appointment as a Volunteer Responder at any time if:

  1. You fail to act in accordance with these Volunteer Terms and Conditions, any applicable Getting You Started Guides and/or any other instructions provided to you by Royal Voluntary Service from time to time; or
  2. Royal Voluntary Service receives any complaints about you or has any concerns about you or your behaviour or actions as a Volunteer Responder.

Royal Voluntary Service will notify you if your appointment is being suspended or terminated.

If your appointment is suspended or terminated, you must immediately cease to accept volunteering tasks via the Volunteer Responder App and to otherwise act as a Volunteer Responder.

7. Data protection

In order to:

  1. Process applications for the role of Volunteer Responder; and
  2. Manage and run the Volunteer Responder Programme

Royal Voluntary Service will need to collect and process personal information relating to individuals who apply and volunteer for the programme.

This will include Royal Voluntary Service sharing some personal information with other organisations (including GoodSAM to enable GoodSAM to perform its obligations to NHSE and Royal Voluntary Service in connection with the Volunteer Responder Programme).

Detailed information about the use by Royal Voluntary Service of volunteer personal information in connection with the Volunteer Responder Programme can be found in Royal Voluntary Service's Volunteer Responder Privacy Notice. The Volunteer Responder Privacy Notice includes information regarding:

  1. The nature of the personal information Royal Voluntary Service will collect and process;
  2. The purposes for which it will process such personal information;
  3. Its lawful bases for processing;
  4. The data sharing and data processing arrangements it has in place with GoodSAM; and
  5. Volunteers' rights under data protection law.

Please ensure that you have read over and understood the information set out in the Volunteer Responder Privacy Notice before you proceed with your application to become a Volunteer Responder.

GoodSAM Terms and Conditions

For the avoidance of doubt, the GoodSAM Terms and Conditions apply as between you and GoodSAM if you use any of the GoodSAM Services.

1. Relationship with GoodSAM

Any individual who uses the GoodSAM Services will enter into a separate relationship with GoodSAM. GoodSAM gives you permission to use the GoodSAM Services and in return, you are required to agree to certain terms of use and privacy information.

By using and/or downloading any GoodSAM Services (including browsing and using the GoodSAM Website and/or using GoodSAM's technology to complete an application to become a Volunteer Responder) you are agreeing to comply with and be bound by the GoodSAM Terms and Conditions. If you disagree with any part of the GoodSAM Terms and Conditions (including the privacy information set out below), please do not use the GoodSAM Services.

2. Additional information about the GoodSAM services

The Volunteer Responder App and other GoodSAM apps are tools that utilize the latest in App development. The Volunteer Responder App has been developed by GoodSAM to facilitate a volunteer response by connecting certain members of the public who, as a result of the UK COVID-19 pandemic, wish to receive voluntary assistance, with a suitable Volunteer Responder.

3. Liability of GoodSAM

Your attention is drawn to the fact that this section contains terms which exclude and/or limit the liability of GoodSAM and/or others

The use of the GoodSAM Services is entirely at your own risk, for which GoodSAM shall not be liable.

The content of the pages of the GoodSAM Website and the content on the Volunteer Responder App or any other GoodSAM app is for your general information and use only. Such content is subject to change without notice.

Neither GoodSAM or any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the GoodSAM Website or the Volunteer Responder App for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and GoodSAM expressly excludes liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of any information or materials on the GoodSAM Website or the Volunteer Responder App is entirely at your own risk and GoodSAM shall not be liable for such use.

It shall be your own responsibility to ensure that any products, services or information available through the GoodSAM Website, the Volunteer Responder App and/or any other GoodSAM apps meet your specific requirements.

The GoodSAM Website contains material which is owned by or licensed to GoodSAM. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these GoodSAM Terms and Conditions.

All trademarks reproduced on the GoodSAM Website or in the Volunteer Responder App or any other GoodSAM apps which are not the property of or licensed to GoodSAM are acknowledged as such therein.

Unauthorised use of any of the GoodSAM Services may give rise to a claim for damages and/or be a criminal offense.

From time to time, the GoodSAM Website, the Volunteer Responder App and/or other GoodSAM apps may include links to other websites. These links are provided for your convenience to provide further information. They do not signify that GoodSAM endorses the website(s). GoodSAM will have no responsibility for the content of the linked website(s).

GoodSAM will not be liable for any injury or misadventure that occurs as a result of your use of the GoodSAM Services. This includes but is not limited to issues relating to the malfunction of any GoodSAM Services and/or technical matters relating to any the Volunteer Responder App and/or any other GoodSAM apps, GPS matters or location inaccuracies.

4. Data protection

Royal Voluntary Service's Volunteer Responder Privacy Notice sets out information about the data sharing and data processing arrangements in place between Royal Voluntary Service and GoodSAM in relation to the Volunteer Responder Programme.

In relation to personal information relating to Volunteer Responders in respect of which GoodSAM becomes a controller, further information about how GoodSAM will process such personal data, the purposes of processing and volunteers' rights under data protection law can be found on GoodSAM's website and when you download and install the Volunteer Responder App.

5. Copyright

Ownership of the copyright in all content contained within the GoodSAM Services belongs or is licensed to GoodSAM. You must not re-use or copy such content without permission. If you wish to reuse any of GoodSAM's content, please contact GoodSAM first to obtain permission. Any permission is granted at the discretion of GoodSAM.

6. Remuneration

GoodSAM will not seek financial remuneration from Volunteer Responders in relation to their use of the GoodSAM Services.

General terms

This document and the terms and conditions set out in it are governed by the laws of England and Wales. Any claims or disputes arising out of or in connection this document or the terms and conditions set out in it will be subject to the exclusive jurisdiction of the courts of England and Wales.

By applying to be an Volunteer Responder, you are agreeing to comply with the terms and conditions set out in this document and to act in accordance with them.
